1. The Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between Mennus ("Mennus," "we," "our," or "us") and you, whether personally or on behalf of an entity ("you," "Customer," or "Cafe Owner"), concerning your access to and use of the website mennus.com and our digital menu SaaS platform (collectively, the "Service").
By accessing or using the Service, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are prohibited from using the Service and must discontinue use immediately.
2. Services Provided
Mennus provides a Software-as-a-Service digital platform enabling restaurants, cafes, and hospitality businesses to:
- Build and publish mobile-optimized digital menus.
- Generate permanent QR codes linking to hosted digital menus.
- Upload menu files for automatic data extraction using AI scanning technology.
- Offer table reservation requests to visitors.
- Review traffic analytics (menu views and item views).
3. Registration and Account Security
You must create an account to access key features. You agree to provide accurate, current, and complete information during onboarding and settings. You are solely responsible for safeguarding your account password and for any activities or actions under your account.
4. Subscriptions, Plans, and Billing
- Plan Tiers: Mennus offers Starter, Pro, and Business (Premium) subscription plans with varying limits on items and features (e.g. table bookings, analytics, watermark removal).
- Manual Billing: Subscription upgrades, downgrades, and renewals are handled manually via communication with support@mennus.com. Mennus does not run automated credit card charges or recurring payment processors on the website.
- Trial Policy: Trial periods are subject to limits specified during signup and onboarding.
- Late Payments: We reserve the right to downgrade plans or suspend account features in the event of non-payment of agreed subscription fees.
5. Intellectual Property Rights
Our Materials: Mennus retains all right, title, and interest in and to the Service, including codebase, designs, layout themes, logo templates, typography styles, and the Mennus trademark.
Customer Materials: You retain all intellectual property rights in the content you upload, including cafe logos, item photographs, menu names, and descriptions. By uploading content, you grant Mennus a limited, non-exclusive license to host and display this content to show your menu to visitors.
6. Acceptable Use & Content Standards
As a Cafe Owner, you represent and warrant that:
- You own or have the necessary licenses to use and display cafe logos and food photography on your menus.
- Your menu content (pricing, ingredients, allergens) is truthful and accurate.
- You will not upload content that violates any trademark, copyright, privacy rights, or local laws of the United Arab Emirates or the Arab Republic of Egypt.
7. Limitation of Liability & Disclaimers
- AI Menu Scanner: The AI menu scanner is provided on an "as-is" and "as-available" basis. It is a tool to accelerate menu creation, and you are solely responsible for verifying the accuracy of prices, names, and translations before publishing your menu. Mennus is not liable for errors generated by the AI parser.
- Reservations: Mennus only provides the table reservation booking utility. We do not manage cafe capacity, walk-in scheduling, or actual table availability. Any disputes, cancellations, double-bookings, or no-shows are strictly between the Cafe Owner and the Cafe Guest. Mennus disclaims all liability for table booking disputes.
- Service Availability: Mennus does not guarantee uninterrupted, secure, or error-free operations. We are not liable for lost revenue, cafe operational disruptions, or menu display downtime.
8. Governing Law
These Terms shall be governed by and construed in accordance with:
- The laws of the United Arab Emirates (Dubai) for users contracting within the Gulf Cooperation Council (GCC).
- The laws of the Arab Republic of Egypt for users contracting within Egypt.
Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Dubai, UAE or Minya, Egypt respectively.
